1. Scope of Application
1.1 The following General Terms and Conditions apply to all legal transactions of Dr. Metzner Health Concepts under this contract with its contractual partner, hereinafter referred to as "Customer" or "Participant." Participants are all users of the online program "Safety Retreat," the Safety Lounge live calls, and the 1:1 coaching, as described on www.safetyretreat.com.
1.2 Changes to these Terms and Conditions will be communicated to the Customer in writing. They are considered approved if the customer does not object in writing. The customer must send the objection to the organizer within two weeks of being notified of the changes.
2. Customers
The services offered by Dr. Metzner Health Concepts are aimed at consumers. A consumer is any natural person who enters into a contract for purposes that are predominantly neither related to their commercial nor their independent professional activity (Section 13 of the German Civil Code). Participants must be of legal age and have the capacity to enter into contracts. Use of the services is at the participant's own risk. In case of acute health problems, it is strongly recommended to consult a medical professional.
3. Subject Matter of the Contract
3.1 The contract is concluded for the service selected by the customer from Dr. Metzner Health Concepts. A precise description and list of the services offered is published by the organizer, among other places, on its website (www.safetyretreat.com) and in other media used by the organizer. The "Safety Retreat" program is designed to impart health-related knowledge and support participants in taking responsibility for their own well-being. It is not an actual physical journey, even though terms like "travel days," "itinerary," and "inner journey" are used. Safety Retreat consists of digital learning content (videos, PDFs, and, where applicable, accompanying live sessions and one-on-one coaching) designed for people with chronic fatigue, long-term COVID-19, or similar stress conditions.
This program expressly does not provide medical treatment, advice, or diagnosis. It is not a substitute for medical or psychotherapeutic care.
3.2 The client receives access to the pre-recorded online video program via the internet (hereinafter referred to as the "Online Program"). Participants in this Online Program can also book individual, optional online coaching sessions (hereinafter referred to as "Online One-on-One Coaching").
The type and scope of the coaching are defined in the service description and the guidelines during the booking process.
The program does not provide medical treatment, advice, or diagnosis.
3.3 The Safety Retreat is an online self-help program with optional one-on-one coaching.
It is not distance learning as defined by the Distance Learning Protection Act (FernUSG).
There are no exams or assessments.
Participation is intended to provide individual guidance and support in coping with stressful situations.
No promises of healing are made, and no medical treatment or training is provided.
Any certificate of participation merely documents participation and does not constitute proof of achievement.
Therefore, the program is exempt from ZFU accreditation.
3.4 We use AI-based translation tools for the language translation and synchronization of individual videos.
These are used exclusively for translation and technical adaptation. The content of the original German version remains unchanged and is by Dr. Jacqueline Metzner.
4. Conclusion of the contract
4.1 The customer has the option to purchase the services offered by Dr. Metzner Health Concepts via the website operated under the domain www.safetyretreat.com. To do so, the customer clicks the corresponding buttons. After submitting their name, telephone number, and email address, and completing the payment process, the customer receives a confirmation email at the email address they provided.
4.2 A binding contract for the services offered by Dr. Metzner Health Concepts, as advertised on the website, is concluded upon the customer's payment. By purchasing the Safety Retreat online program, the customer receives a membership with a term of one year. The membership ends automatically without requiring cancellation. No further payments or fees are due.
5. Online Program Safety Retreat, Live Subscription, and Online 1:1 Coaching
5.1 To access the purchased services, participants need an internet-enabled device. The customer is responsible for ensuring this requirement is met.
5.2 The services are provided as described on the website www.safetyretreat.com.
5.3 The Safety Lounge is a voluntary, free supplementary offering for participants of the Safety Retreat online program, conducted via Zoom. It serves as a forum for exchange and in-depth reflection on the program content. This offering is not part of the booked program and is not included in the contractually agreed scope of services. There is no entitlement to its execution, regular dates, specific content, or duration. The format, frequency, and dates may vary and will be announced on the platform as needed. The organizer reserves the right to modify, pause, or discontinue the Safety Lounge at any time. Changes to or the discontinuation of the Safety Lounge do not entitle participants to a reduction in fees, cancellation, or compensation and have no effect on the existing program agreement.
Participants are not authorized to independently record live sessions, take screenshots, or share content without our consent.
5.4 Individual 1:1 coaching is a supplementary, fee-based service available only to participants of the Safety Retreat Program. Appointments are scheduled based on availability. There is no guarantee of immediate or regular appointments. If demand temporarily exceeds available capacity, waiting times may occur. Coaching is an individual consultation and support service. It does not replace medical or psychotherapeutic treatment.
Payment: The fee is due before the start of the session and is payable via the offered payment methods.
Cancellation: Cancellations are free of charge up to 24 hours before the appointment. Later cancellations or no-shows: 20% of the fee is due. The agreed duration of a coaching session begins at the agreed time. Delays on the part of the participant are their responsibility and do not entitle them to an extension of the agreed session. The fee will not be reduced. The right of withdrawal expires as soon as the service has been fully rendered (§ 356 para. 4 German Civil Code).
6. Prices and Payment Terms
6.1 The fees and prices listed on the website www.safetyretreat.com apply. All prices include all taxes and duties (total prices).
6.2 The customer is required to pay for the services in advance.
6.3 Payment is processed via:
Credit Card
Your credit card will be charged by the payment service provider Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland.
Apple Pay
If you select this payment method, payment processing will be handled by the Apple Pay service of Apple Distribution International Ltd., Hollyhill Industrial Estate, Hollyhill, Cork, Ireland. The charge will be processed via the payment method saved in your Apple Pay account (e.g., credit or debit card).
PayPal
If you select this payment method, payment processing will be handled by PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg. A PayPal account is required to use this service. Further information on PayPal's terms of service and privacy policy can be found at:

Payment via PayPal is processed immediately after the order is placed. Any refunds will be processed – where technically possible – via the originally selected payment method.

7. Termination
7.1 Membership in the Safety Retreat online program ends automatically after one year. No cancellation is required.
7.2 Exclusion from Safety Lounge Live Calls by Us
We reserve the right to exclude participants from the Safety Lounge for good cause.
Good cause exists in particular if participants:
repeatedly violate netiquette,
insult or disrespect other participants or the moderators,
misuse the content of the live calls (e.g., unauthorized distribution, recording, or publication).
8. Scope of Services and Unused Services
8.1 The scope of services is determined by the information on the website www.safetyretreat.com
9. General Terms and Conditions of Participation, Exclusion of Participants
9.1 The Dr. Metzner Health Concepts reserves the right to exclude individual participants from live calls and online 1:1 coaching sessions if providing services with that participant is deemed unreasonable for Dr. Metzner Health Concepts.
9.2 A legitimate reason for excluding a participant exists, in particular,
– if the participant repeatedly disrupts live calls or other live sessions despite a single warning from the Dr. Metzner Health Concepts coaches or hinders the group's progress.
– if the participant lacks the necessary technical resources to participate in the coaching.
10. Confidentiality
Dr. Metzner Health Concepts undertakes to maintain confidentiality regarding all personal information disclosed by the client for the purpose of providing services. Personal data is processed in accordance with the privacy policy on the "Privacy" page of the website www.safetyretreat.com.
The disclosure of the information described in the preceding paragraph to third parties is prohibited. This does not apply if Dr. Metzner Health Concepts is legally obligated to disclose the data.
The confidentiality obligation does not apply to information that is generally known or becomes generally known, nor in cases of legal or regulatory disclosure requirements.
11. Intellectual Property
11.1 The intellectual property rights to all coaching materials created by Dr. Metzner Health Concepts remain with Dr. Metzner Health Concepts. All content of the Safety Retreat® online program (including videos, audio files, PDFs, worksheets, community posts, and live calls) are protected by copyright.

11.2 Upon booking, the participant receives a simple, non-exclusive, and non-transferable right to use the program content. Use is permitted exclusively for private, personal purposes.
11.3 The transfer, reproduction, publication, or use of the content for professional or commercial purposes—in particular for the development, promotion, or implementation of one's own programs, coaching sessions, or similar offerings—is expressly prohibited.
11.4 Dr. Metzner Health Concepts reserves the right to block access and take legal action if content is misused or these terms are violated.
12. Liability
12.1 Dr. Metzner Health Concepts shall be liable in all cases of contractual and non-contractual liability for intent and gross negligence in accordance with statutory provisions.
12.2 In all other cases, Dr. Metzner Health Concepts shall only be liable for breach of a contractual obligation, the fulfillment of which is essential for the proper performance of the contract and on which the customer may therefore regularly rely (so-called cardinal obligation). In all other cases, liability is excluded.
12.3 To the extent that Dr. Metzner Health Concepts is liable, this liability shall be limited to damages that Dr. Metzner Health Concepts foresaw, or should have foreseen, at the time of conclusion of the contract as a possible consequence of a breach of contract. Indirect and consequential damages resulting from defects in performance by Dr. Metzner Health Concepts shall only be recoverable to the extent that such damages are typically to be expected when the service is used as intended.
12.4 The liability of Dr. Dr. Metzner Health Concepts' liability for damages resulting from injury to life, body, or health, and under the Product Liability Act, remains unaffected by the aforementioned limitations and exclusions of liability.
12.5 Dr. Metzner Health Concepts assumes no liability for:
- health, psychological, or physical consequences related to the use of the content; this does not constitute a promise of healing.
- individual success.
- technical malfunctions, interruptions, or data loss that are beyond its control.
12.6 Activities, information, and services provided by employees or other agents in connection with the online program are carried out in the name and on behalf of Dr. Metzner Health Concepts.
The management is solely responsible for legal responsibility and external impact. Employees or contributors are not personally liable to customers.
13. Set-off, Assignment, and Rights of Retention
13.1 The customer is only entitled to set off claims against Dr. Metzner Health Concepts that have been legally established or are undisputed. The same applies to the assertion of rights of retention.
13.2 The assignment of claims against Dr. Metzner Health Concepts to third parties is only possible with the prior written consent of Dr. Metzner Health Concepts.
14. Copyright
All content is protected by copyright and may not be reproduced, distributed, or made publicly available without express written permission.
15. Miscellaneous Provisions
Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected. The laws of the Federal Republic of Germany shall apply exclusively, excluding international private law and the UN Convention on Contracts for the International Sale of Goods (CISG).
Amendments and modifications to the agreements made between Dr. Metzner Health Concepts and the customer, including these Terms and Conditions, require written form to be effective.
The place of performance and jurisdiction is Überlingen, to the extent legally permissible.
This program is not accredited under the German Distance Learning Act (FernUSG) because no course-related assessment of learning outcomes is conducted.
Note: These Terms and Conditions do not constitute a promise of healing. The program is aimed at individuals who wish to actively support their health, but not at those requiring medical treatment or therapy.
The accompanying online 1:1 coaching serves to deepen and individually apply the content of the self-help program. It does not replace medical advice, diagnosis, or treatment. For legal reasons, no medical recommendations or therapy decisions can be made during coaching. Exhaustion (fatigue) can have various causes that require an in-person medical evaluation. Remote assessment is not possible.
No promises of healing or guarantees regarding the course of treatment can or may be given.

5. Handling of Complaints
Dr. Metzner Health Concepts does not participate in dispute resolution proceedings before a consumer arbitration board. Complaints can be submitted at any time to the postal and email addresses provided in section 1 of this customer information and will be processed by Dr. Metzner Health Concepts without undue delay.
6. Warranty Rights

7. Contract Term and Termination
The contract term and the conditions for termination are governed by Section 7 of the General Terms and Conditions (GTC) outlined above.
8. Right of Withdrawal
For digital content that is activated immediately after purchase, the statutory right of withdrawal pursuant to Section 356 Paragraph 5 of the German Civil Code (BGB) expires if the participants expressly agree that performance will commence before the end of the withdrawal period.
